TERMS OF SERVICES

Welcome to Escarraga's Luxury Cleaning, Inc.! These Terms of Service ("Terms") outline the agreement between you ("Client") and Escarraga's Luxury Cleaning, Inc. ("we," "us," or "our") for the provision of cleaning and related services. By engaging our services, you acknowledge and agree to be bound by these Terms.

1. Services

We provide a variety of cleaning and related services, including but not limited to commercial cleaning, janitorial services, floor care, window cleaning, and special event cleaning. The specific services to be provided will be outlined in a separate service agreement or quote.

2. No Contractual Obligation

Unless otherwise agreed to in writing, our services are provided on a no-contract basis. This means you are not obligated to a long-term agreement and may discontinue our services at any time. Similarly, we may discontinue providing services to you at our discretion.

3. Pricing

  • Our prices are subject to change. We will provide you with at least a 30-day notice of any price changes. Factors such as the scope of work, frequency of service, and market conditions may influence our rates.

  • Quotes will typically be generated within 48-72 business hours of our walkthrough assessment of your property. Please note that quotes for medical facilities and special events may require additional time due to the specialized nature of these services.

  • We will provide you with a detailed quote before commencing any service. It is your responsibility to review and approve the quote before we begin.

  • For ongoing services, we may adjust pricing and service frequency as needed, with a 30-day notice provided to you.

4. Payment

  • Invoices will be issued weekly and delivered electronically via email.

  • Payment is due within 30 days of the invoice date.

  • We accept payments via check, credit card, and online payment platform (e.g., Apple Pay, PayPal).

  • You are required to keep at least one valid payment method on file with us to facilitate timely payments and ensure efficient service delivery.

  • For new cleaning services at a property we have not previously serviced, a 30% non-refundable deposit is required to secure the booking. The remaining balance is due upon completion of the service.

  • A grace period of 14 days will be provided after the payment due date before a late fee is applied.

  • We will attempt to automatically charge your payment method on file after the grace period expires. If the payment is declined, we will add the applicable late fee and send you a notice.

  • Late payments may be subject to a late fee of 5% of the outstanding balance, after the grace period.

  • If you require a different invoicing frequency (e.g., bi-weekly, monthly), please let us know, and we will accommodate your request if possible.

5. Communication

  • Client: Please ensure that your contact information is up-to-date and that you are available to respond to our communications regarding scheduling and service confirmations. If we are unable to reach you to confirm service details, we may need to reschedule your service or, in some cases, consider the service cancelled (subject to applicable cancellation fees).

  • Company: If you do not receive a response from us within 72 business hours, please follow up to ensure we received your communication.

Add-on Services: If you require any add-on services beyond the initially agreed-upon scope of work, please notify us as soon as possible. We will provide you with a revised quote for the additional services, and your approval will be required before we proceed.

6. Service Details

  • The scope of services will be agreed upon before each cleaning or project. It is your responsibility to clearly outline your requirements and provide access to all areas that require cleaning.

  • We will make reasonable efforts to perform the services to your satisfaction, using industry-standard practices and appropriate cleaning products. However, due to the nature of cleaning services, we cannot guarantee the complete elimination of all dirt, stains, or bacteria.

  • If you have any concerns or are dissatisfied with any aspect of our service, please notify us within 24 hours of the service completion and provide photographic evidence of the issue. We will make reasonable efforts to address your concerns and rectify any deficiencies. 

  • For medical facilities, we adhere to all applicable health and safety regulations and use cleaning products and procedures that are compliant with infection control standards.

  • We are not responsible for damage to personal belongings or property if reasonable care has been taken. Please ensure valuables are secured or removed from the service area before our arrival. We recommend that you take appropriate precautions to protect sensitive electronic equipment and documents.

  • We reserve the right to refuse service or to charge additional fees if the work environment is deemed unsafe, unsanitary, or presents unusual cleaning challenges that were not disclosed to us prior to the commencement of services.

  • Cancellation: 

    • First-Time Service: If you need to cancel a scheduled first-time service, please provide us with at least 72 hours' notice. If you cancel with less than 72 hours' notice, your deposit will be retained.

    • Ongoing Service: If you need to cancel a scheduled ongoing service, please provide us with at least 72 hours' notice. Cancellations made with less than 72 hours' notice may be subject to a cancellation fee of $100 or 25% of the scheduled service cost, whichever is lower. Alternatively, at our discretion, we may apply a credit of $100 or 25% of the service cost (whichever is lower) towards your next scheduled service.

7. Limitation of Liability

  • TO THE MAXIMUM EXTENT PERMITTED BY CALIFORNIA LAW, our liability for any claims arising from our services is limited to the amount you paid for the specific service in question.

  • WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR SPECIAL DAMAGES ARISING FROM OUR SERVICES, INCLUDING BUT NOT LIMITED TO LOST PROFITS, LOST DATA, OR LOSS OF GOODWILL, UNLESS SUCH DAMAGES ARE THE RESULT OF OUR GROSS NEGLIGENCE OR WILLFUL MISCONDUCT.

  • We are not liable for any damage caused by pre-existing conditions in your property, normal wear and tear, or damage caused by events outside of our control, such as natural disasters or acts of third parties.

8. Indemnification

You agree to indemnify and hold us harmless from and against any and all claims, losses, liabilities, damages, costs, and expenses (including reasonable attorneys' fees) arising out of or related to your use of our services, your breach of these Terms, or your negligence or misconduct.  

9. Contracts

If a separate contract is executed between you and Escarraga's Luxury Cleaning, Inc. for specific services, the terms of that contract will govern the provision of those services. In the event of a conflict between these Terms and the terms of a separate contract, the terms of the contract will prevail.

10. Modifications to Terms

We reserve the right to modify these Terms at any time. Any changes will be posted on our website, and it is your responsibility to review them periodically. Your continued use of our services following any changes constitutes acceptance of the updated Terms.  

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California.  

12. Dispute Resolution

Any dispute arising out of or relating to these Terms or the provision of our services shall be settled amicably through mutual discussion. If the parties are unable to reach a resolution through discussion, the dispute shall be settled through binding arbitration in accordance with the rules of the American Arbitration Association.  

13. Entire Agreement

These Terms constitute the entire agreement between you and Escarraga's Luxury Cleaning, Inc. with respect to the subject matter hereof and supersede all prior or contemporaneous communications, representations, or agreements, whether oral or written.  

14. Waiver

No waiver of any provision of these Terms shall be effective unless in writing and signed by the waiving party.


15. Severability

If any provision of these Terms is held to be invalid or unenforceable, such provision shall be struck from these Terms and the remaining provisions shall remain in full force and effect.
